Congress Must Empower State AGs to Hold the Airlines Accountable

August 31, 2022 Press Release

Washington, D.C. — In response to a new letter from a bipartisan group of 38 state attorneys general urging Congress to allow them to enforce consumer protections for airline travelers, the American Economic Liberties Project today released the following statement.

“This letter from a bipartisan set of state attorneys general from across the country crystalizes what we’ve been saying for months now,” said William J. McGee, Senior Fellow for Aviation and Travel at the American Economic Liberties Project. Since Transportation Secretary Pete Buttigieg has failed to protect air travelers during this summer of endless flight disruptions, state enforcers should be empowered to do so. Congress must take swift action to eliminate the federal preemption liability shield and begin correcting decades of failed regulatory enforcement by the U.S. Department of Transportation.

The American Economic Liberties Project works to ensure America’s system of commerce is structured to advance, rather than undermine, economic liberty, fair commerce, and a secure, inclusive democracy. Economic Liberties believes true economic liberty means entrepreneurs and businesses large and small succeed on the merits of their ideas and hard work; commerce empowers consumers, workers, farmers, and engineers instead of subjecting them to discrimination and abuse from financiers and monopolists; foreign trade arrangements support domestic security and democracy; and wealth is broadly distributed to support equitable political power.
